MediGrow.app (“MediGrow,” “we,” “our,” “us”) is a healthcare business-automation platform owned and operated by
M G Digital Marketing, Dubai, United Arab Emirates.
By signing up for or using
MediGrow.app, you (“you,” “clinic,” or “customer”) agree to these Terms, our
Privacy Policy, and any additional policies we reference.
If you do not agree, please discontinue use of
MediGrow.app.
2. Purpose and Use of Service
MediGrow.app helps clinics and healthcare professionals manage marketing, leads, communication, and patient engagement.
You agree to use the platform only for lawful business purposes and to:
- Obtain patient consent before sending messages by SMS, WhatsApp, or email.
- Avoid spam, misleading, or prohibited medical claims.
- Identify clearly when an AI assistant (such as Mary AI) is communicating.
- Follow all applicable advertising, healthcare, and data-protection regulations.
3. Account Ownership and Access
The person or entity paying for the subscription is the legal account owner.
If MediGrow creates or manages your account under its platform, administrative ownership remains with M G Digital Marketing until all dues are cleared.
Unpaid or inactive accounts may be suspended after 30 days; stored data may be permanently deleted after 90 days.
4. Data Privacy and Security
- You are the data controller for any patient or lead data you store.
- M G Digital Marketing acts as your data processor.
- Data is hosted on secure, enterprise-grade cloud infrastructure managed by vetted third-party providers bound by strict confidentiality and data-protection agreements.
- Data is encrypted in transit and at rest and maintained in accordance with international privacy standards, including UAE PDPL and GDPR.
You must:
- Collect valid consent before storing or contacting patients.
- Respond promptly to any data-access or deletion requests.
- Notify MediGrow within 48 hours of any suspected data breach.
MediGrow assists with compliance but is not liable for your violation of privacy or marketing laws.
5. AI Features and Automation
MediGrow’s AI assistant (Mary AI) automates replies, reminders, and lead nurturing. By enabling AI features, you acknowledge that:
- AI responses may be inaccurate or incomplete.
- They do not constitute medical or professional advice.
- You remain responsible for reviewing all AI-generated content before use.
- You will avoid inputting unnecessary sensitive or diagnostic data into AI prompts.
6. Messaging and Communications
You are the
legal sender of every message sent via
MediGrow.app. You must comply with:
- UAE Telecommunications and Digital Government Regulatory Authority (TRA) rules,
- GDPR / CAN-SPAM / TCPA regulations, and
- WhatsApp Business and other platform policies.
MediGrow provides the technology only and is not responsible for delivery delays, carrier filtering, or fines due to misuse.
7. Domains, Phone Numbers & Integrations
Any domains, phone numbers, or integrations procured or managed by MediGrow remain under the administrative control of M G Digital Marketing until all invoices are settled.
We recommend maintaining your own domain, email, and phone accounts for continuity.
8. Pricing, Billing & Refund Policy
- Subscriptions are billed monthly or annually in AED.
- All fees are non-refundable once charged.
- Messaging credits (SMS/WhatsApp) are deducted from your wallet in real time.
- Negative wallet balances may be automatically charged to your stored card.
- Cancellation requests must be made through your dashboard or in writing.
- Pricing and plan features may change with 15 days’ notice.
9. Fair Use Policy
Plans labeled “unlimited” are subject to reasonable and fair-use standards. Excessive consumption affecting platform performance may require plan upgrade or temporary throttling.
10. Termination of Service
MediGrow may suspend or terminate your account if you:
- Violate these Terms or applicable laws, or
- Fail to make payment within 15 days of the due date.
Upon termination, access is disabled immediately. You may request data export within 90 days of termination; after that period data is deleted.
11. Intellectual Property
All software, workflows, templates, branding, and AI modules remain the exclusive property of M G Digital Marketing.
You receive a non-exclusive, revocable license to use the platform while your subscription is active.
You may not copy, resell, or reverse-engineer any portion of
MediGrow.app.
12. Limitation of Liability
MediGrow.app is provided “as is” and “as available.” We do not guarantee specific results, lead volume, or revenue growth.
Our total liability for any claim shall not exceed the fees you paid in the preceding three months.
We are not liable for indirect or consequential losses, including loss of data or business opportunity.
13. Indemnification
You agree to indemnify and hold harmless M G Digital Marketing and its affiliates against any claims, fines, or damages arising from:
- unlawful use of the platform,
- spam or consent violations,
- mishandling of patient data, or
- breach of these Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of Dubai, United Arab Emirates.
Any dispute shall be resolved by binding arbitration under UAE jurisdiction.
MediGrow may seek injunctive relief to protect its intellectual property or confidential information.
15. Changes to These Terms
We may update these Terms from time to time. The latest version will always be available at
medigrow.app/terms.
Continuing to use the platform after updates means you accept the revised Terms.
